By agreeing to the terms and conditions of this Agreement, the Seller hereby authorizes SelliPhones to purchase the Item(s) as quoted on the Customer Order form.
Your receipt of an order confirmation signifies that SelliPhones.com.au will only pay full value if the cell phones and/or electronics sent meet the condition outlined below. By shipping your cell phones and/or electronics to SelliPhones.com.au, you confirm your acceptance of our price and terms.
Each cell phone or electronic device must be in 100% working condition, which includes but not limited to the following:
It will power on and the battery will be able to receive and hold a charge.
All devices must include a working battery. Make sure the device is fully charged before it is sent. Accessories, such as chargers, Bluetooth headsets, and cases are accepted; please include them if not in use.
LCD display(s) must fully work and not be broken, bleeding or cracked or damaged in any fashion.
All members of the keypad/keyboard must work and all scroll bars and roller bars must work. All removable parts (like battery doors) must be included.
The antenna (if applicable) is intact and fully functional and the body of the phone where the antenna meets is not cracked or separated.
Cases should be complete and unbroken, no cracks, No loose or broken flips, slide, or swivel. Minor scratches and nicks are acceptable.
Ringer works, speaker and microphone work, camera works and all web browsing functions, including PDA and GPS functions work as designed.
All features of that particular model must work, such as, texting, touch screen, email, push-to-talk, MP3, games, GPS, satellite connection etc.
No red dots! (Check inside the phone behind the battery. If you see a red dot you should know that this phone will be considered broken, even if it works. A red dot means contact with moisture and voids even the manufacturer warranty. Also look at the battery which in some cases will have a similar color changing mechanism used to indicate water contact.) Do not remove the red dot. A phone that is missing it’s moisture indicator will not be purchased either.
PHONES WITH SIM CARDS DO NOT NEED TO BE RELEASED OR HAVE A ZERO BALANCE. All others MUST be "released" from your service provider i.e. Verizon, Sprint, etc. and not have an account balance, reported lost or stolen. In other words, it must be able to be reactivated, without exception.
It should not be stolen or found. If a phone is reported stolen by it's service provider, it will be reported to proper authorities.
Cell phones should not have active service or an unpaid balance. It is the user’s responsibility to discontinue the service with their provider before shipping the cell phone. Any and all charges incurred if such service is not cancelled will be the responsibility of the user. Sprint PCS customers, Verizon Wireless customers, and Virgin Mobile customers must have free and clear equipment before it is sent to Phoniscash.com, Inc. We are not responsible for previous or subsequent airtime charges accrued prior, during, or after any transaction. Should any airtime charges be accrued, it is the responsibility of the original user and service provider to resolve payment issues.
Each cell phone and other electronic equipment must have a valid, verifiable, and legible IMEI, ESN, or other Serial Number. That means we will not accept a phone or other electronic equipment that is missing the serial number sticker inside or is scratched off of blotted out and will not be eligible for return.
It is the SELLER'S (you) responsibility to remove all pictures, phone numbers, and other data from each cell phone or other electronic equipment being sold.
When listing models, you must use the actual model number written inside the phone or other electronic equipment. Do not judge the model by picture alone as many models are nearly identical. Incorrect models will be paid the corrected model amount due based on cosmetic and functionality rating.
Any cell phones sent in other than those listed on the initial online order will not be returned and will become the property of SelliPhones.com.au, Inc. Please verify the accuracy of your transaction before submitting for approval. However, if the device is listed on our site for payment it will be added to the total amount paid.
All Products are inspected upon receipt by SelliPhones.com.au. SelliPhones.com.au reserves the right to accept or deny the Item. SelliPhones.com.au reserves the right to determine the cell phone condition and make adjustments to the offer accordingly. SelliPhones.com.au may recalculate the original quote for the item if the item does not meet the condition listed above at the "Condition requirements" section. In the event that SelliPhones.com.au recalculates a quote, SelliPhones.com.au will email you and you will have the option to accept or reject that new quote within (5) days.
If you chose to reject the new quote, SelliPhones.com.au will return the item to you if request at your own expense. You have FIVE (5) days to place in the mail an envelope containing a US money order (no personal checks) to cover return postage and costs. Five days is determined by measuring from the date you decline to the post mark on your envelope (it must be five days or less in order to get them back). If not mailed within 5 days, any phones or other electronic equipment on hold will be recycled and no longer available.
In the event that you do not reject the new offer, SelliPhones.com.au will automatically accept the Item with the new quote.
If the new quote is neither accepted nor rejected after the 5 days, SelliPhones.com.au will assume acceptance of the new quote, and you will be paid the new quote.
Releasing Rights to Product
Once you send SelliPhones.com.au your product, SelliPhones.com.au cannot and does not guarantee that it will be able to honor any request for return of the product and/or any data or information contained in said product.
Passing of Title
Title of the item passes to SelliPhones.com.au upon arrival and acceptance at SelliPhones.com.au's processing center. The passing of title is final, and all decisions regarding items are at the sole discretion of SelliPhones.com.au.
Risk of Loss
When you ship your phone(s) or other electronic equipment, make sure they are packed well and secured so that upon arrival they will not be crushed or otherwise damaged from shipping. We do not accept liabilities associated with shipping including damaged while in transit, or lost or stolen while in transit
If you are sending high dollar phones or other electronic equipment, we recommend that you consider shipping insurance.
Accuracy of Information
As part of the communication process, it is the seller's responsibility to maintain their personal information in their account. If you move to a new address or change your phone number, please update your account accordingly. Any returns and/or checks mailed to an incorrect address will not be the responsibility of SelliPhones.com.au, and as such, SelliPhones.com.au will not assume or be assigned the liability of the return or check that was sent to an unmodified addressed. If a request is made to have another check sent to a modified address, a stop payment fee of $30.00 will be applied to your payout and deducted from the new check written and mailed to you.
All pricing is subject to change without notice. For all prices, products and offers, SelliPhones.com.au reserves the right to make adjustments due to changing market conditions, product availability, and other extenuating circumstances.
Expiration of Offer
All trade offers will expire 30 days from the date of trade confirmation or from the date the seller placed the initial order.
For all Items that use hard drives, memory cards, or other means of storing data, it is the responsibility of the Seller to remove any and all personal or sensitive data or information stored in the Item(s), before the Item(s) are sent to SelliPhones. This includes, but is not limited to: phonebook information, personal codes, e-mail addresses, personal addresses, IM addresses, photos, and downloaded files. By sending your Item(s) to SelliPhones, you agree to release us from any claim or liability as to the Item(s) and data stored in such Item(s), or any information on any media used in conjunction with the product and which you send to SelliPhones, or for such data's security, integrity, confidentiality, disclosure or use. SelliPhones is not responsible for any loss suffered by you as a result of any data that is not erased from the Item and obtained by a third party.
Payment will be made after 30 days of the receipt of the cell phone.
